Medicaid Waiver Program

Attendant Care/Act 150 Waiver

If you have a physical disability, the Attendant Care Waiver and state funded Act 150 program may be available to you to continue to live in your home and community with support and services.

To be eligible for Attendant Care Services, you must:

  • Be a resident of Pennsylvania
  • Meet the level of care needs for a Skilled Nursing Facility for the Medicaid Waiver. Those who do not meet the Skilled Nursing Facility level of care MAY qualify for the PA State funded Act 150 Program
  • Be between eighteen (18) and fifty-nine (59) years of age
  • Be capable of a) hiring, firing, and supervising attendant care worker(s); b) managing your own financial affairs; and c) managing your own legal affairs
  • For the Medicaid Home and Community Based Waiver Services Attendant Care Program, meet the financial requirements as determined by your local County Assistance Office.
  • Have a medically determinable physical impairment that is expected to last of a continuous period of not less than twelve (12) calendar months or that may result in death
  • To take advantage of the Attendant Care Act 150 Program, you may be assessed a minimal co-payment. This co-payment is based on your income and will not be more than the total costs of services

  • Community Transition Services (available only through Medicaid Home and Community Based Waiver Services)
  • Financial Management Services
  • Participant-Directed Community Supports
  • Participant-Directed Goods and Services
  • Personal Assistance Services
  • Personal Emergency Response System (PERS)
  • Service Coordination

Independence Waiver

If you are an adult with a severe physical disability, the Independence Waiver may be able to help you live or remain in the community and remain as independent as possible.

To be eligible for the Independence Waiver you must:

  • Be a Pennsylvania resident
  • Be 18-60 – Individuals that turn 60 while in the waiver will be able to continue to receive services through the Independence Waiver.
  • Individuals who are physically disabled (but not with mental retardation or have a major mental disorder as a primary diagnosis), who reside in a Nursing Facility (NF) or the community but who have been assessed to require services at the level of nursing facility level of care.
  • In addition, the disability must result in substantial functional limitations in three or more of the following major life activities:
    • Self-care
    • Understanding and use of language
    • Learning
    • Mobility
    • Self-direction and/or capacity for independent living
  • Meet the financial requirements as determined by your local County Assistance Office.

  • Adult Daily Living Services
  • Accessibility Adaptations, Equipment, Technology and Medical Supplies
  • Community Integration
  • Community Transition Services
  • Financial Management Services
  • Home Health
  • Non-Medical Transportation
  • Personal Assistance Services
  • Personal Emergency Response System (PERS)
  • Respite
  • Service Coordination
  • Supported Employment
  • Therapeutic and Counseling Services

Aging Waiver

The Pennsylvania Department of Aging Waiver is a long-term living program that provides older Pennsylvanians the help they need to live independently in their own homes and communities.

Consider these benefits as you read about the Aging Waiver:

  • Provides a long term living opportunity other than a nursing facility;
  • Allows you to receive services in your home;
  • Offers a wide array of home health and personal care services;
  • Gives you a choice of approved services and providers;
  • Qualifies participants for other Medical Assistance benefits; and
  • Provides on-going support and assistance from the local Area Agency on Aging.

What services are available?

Home health and personal care services, home support, attendant care, respite care, adult day care, transportation, home modifications, specialized medical equipment and supplies, counseling, extended state plan physician services, home delivered meals, personal emergency response, and companions. Care management and service coordination is provided by the Area Agency on Aging.

Who is eligible?

You must be a resident of Pennsylvania, at least 60 years of age, and meet all of the following criteria:

  • Be clinically and financially eligible for MA services
  • Can be served in the community by available health and social services;
  • Meet the financial requirements, as determined by your local county assistance Office.
  • Agree to the requirements and responsibilities of the program.

How does the program work?

Each Aging Waiver participant will have the support of their Area Agency on Aging. The agency’s staff will regularly assess your needs; help develop and maintain an appropriate plan of care; assist in selecting Medical Assistance and program approved services and product providers, and monitor the quality of the services provided.

COMMCARE Waiver

A Home and Community-Based Services Waiver for Individuals with Traumatic Brain Injury (TBI).

If you have a medically determined diagnosis of traumatic brain injury (TBI), the COMMCARE Waiver can help you remain as independent as possible.

Eligibility

To be eligible for the COMMCARE Waiver you must:

  • Be a Pennsylvania resident
  • Be 21 years of age or older
  • Have a medically determinable diagnosis of traumatic brain injury and require a Nursing Facility (NF) level of care
  • Meet the financial requirements as determined by your local County Assistance Office.

Services available may include:

  • Accessibility Adaptations, Equipment, Technology and Medical Supplies
  • Adult Daily Living
  • Community Integration
  • Community Transition Services
  • Home Health
  • Non-Medical Transportation
  • Personal Assistance Services
  • Personal Emergency Response System (PERS)
